COVID 19 Liability Waiver:

Aquatic Safety, LLC is committed to providing a safe training environment for our participants. We want to make sure you are aware of the steps Aquatic Safety is taking so that you can make your own decision about the risks associated with the potential spread of COVID-19 in training settings. Among other things, we are working with our facilities to institute new cleaning and disinfecting protocols, requiring social distancing as much as possible, requiring all employees and participants who are ill to stay home.

  • ALL participants MUST be fully vaccinated with proof of vaccination, no exceptions.

  • Masks must always cover the nose and mouth while in the classroom setting.

  • Masks MAY NOT be worn while conducting water or CPR skills. Participants WILL be in close proximity of other participants during water skills.

I, in my legal capacity, do hereby acknowledge, understand, and agree on behalf of both myself, and the minor that:

  1. Any use of facilities, equipment, and any participation in or activities of aquatic and Health and Safety training comes with inherent risks including, but not limited to, illness, disease and other ramifications which may result due to exposure to and/or infection with viruses or bacteria such as the coronavirus/COVID-19,

  2. The foregoing list is not inclusive of all possible coronavirus/COVID-19 risks associated with facilities and programs it in no way limits the operation of this agreement,

  3. I accept and assume full responsibility for these risks, and I am not relying on all such risks to be described in this document,

  4. I will fully and accurately complete all Aquatic Safety, LLC forms and submit to procedures as follows: i.

    1. On the first day at any of the trainings, I will bring this completed waiver and provide to Aquatic Safety staff,

    2. Provide proof of vaccination,

    3. Any other document(s) that may be required by Aquatic Safety, and

    4. I will permit to have temperature screened before each entry into the facility and training program,

  5. During the participation in programs, I will promptly notify the Aquatic Safety staff if I, or anyone residing with me is diagnosed with COVID-19 or has been in close contact with someone who has been diagnosed with COVID-19, and I will not come to the training until a health care provider certifies that I am not contagious and may return to the training program,

  6. I will not come to the training at any time I am ill, symptomatic or has a fever of 100◦ Fahrenheit, and I will not return to facilities or any programs until I am not symptomatic for at least 24-hours without the use of prescription or over the counter medications,

  7. I understand that while in the water, face-masks cannot be worn for safety, the participant will be in close proximity and exposed to other participants in class without a mask, and that social distancing cannot be enforced while practicing in-water skills.

“There is currently no evidence to suggest that COVID-19 is spread person to person via the water in environments such as pools or spas. The primary spread in these environments would be by close proximity of individuals, which is often encountered during recreation or exercise activities. Additionally, close quarters such as facility classrooms, locker rooms, and other common spaces are potential environments for increased risk of disease transmission. There is also risk of transmission for lifeguards during rescues and removals from the water where the guard may be in close proximity to the victim. Lastly, while not the primary method of transmission, there is the possibility of transmission via surfaces at the facilities.” (American Red Cross Scientific Advisory Council Answer COVID-19 and Aquatics. 18 May 2020).

  8. Coronavirus/COVID-19 is an extremely contagious virus that spreads through person-to-person contact. Federal and state authorities recommend social distancing and other methods as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Attending and/or participating in training programs could increase the risk of exposure and contracting COVID-19. Aquatic Safety and the rented facility in no way guarantees, warrants or represents that COVID-19/Coronavirus infection will not occur through participation in aquatic or Health and Safety training or by use of the rented facilities.

  • I agree to immediately leave my training if I suddenly feel sick during the training.

  • I agree to self-monitor my health for symptoms associated with COVID-19 and to self-check my temperature before coming to training each day.

  • I will seek treatment and/or advice for an appropriate healthcare provider if I have any COVID-19 symptoms and not report to training until I have discussed my situation and been cleared by my healthcare provider.
